In most cases there will be no changes to workplace rights from 1 January 2021.

However, there will be some changes to rules on:

  • employer insolvency for UK employees working in the EU
  • membership of European Works Councils


However, for a 'no deal' scenario, employees working in an EU country should confirm whether they will still be protected under the national guarantee fund established in that country, by making themselves aware of the relevant implementing legislation in the EU country in which they work.

UK businesses with European Works Councils, and trade unions that are parties to European Works Council agreements, may also need to review those agreements in the event of a 'no deal' scenario as in that case there would no longer be reciprocal arrangements between the UK and the EU.
